After months of advance hype and threats, Team Obama is reportedly set to file suit against the state of Arizona over its immigration enforcement law

The federal government's suit names the State of Arizona as well as Governor Janice Brewer as defendants. It appears that the answer to months of pleading by Governor Brewer with the Obama administration to assist her and her state with the immense burden of the illegal penetration of their southern border with Mexico and the rampant crime, including murder of ranchers, kidnapping, and human and drug trafficking, was to be sued. The job of enforcing the borders from such activity lies first with the federal government. But as anyone who has followed this story knows, the federal government has not done its job and our border states and the entire nation are impacted by this failure to enforce our laws. This failure of federal government to do its enforcement of immigration law and protection of the borders is not limited to Obama as the Bush administration was guilty as well.

Unfortunately, the Holder DOJ is refusing to prosecute voter intimidation cases and is prohibiting its attorneys from testifying before a civil rights commission. The ongoing negligence of the Obama administration is turning the Gulf oil spill disaster into total destruction of coastal environments and the economies that depend on that Gulf coastline. And today we learned that NASA is being charged with promoting its programs for the purpose of making Islamic countries feel better about themselves. And if these matters are not enough to invite a leadership response from D.C., the most important item on Obama's agenda is to sue a state and its governor for trying to protect themselves and for doing the job Obama's administration refuses to do.

The lawsuit, which three sources said could be filed as early as Tuesday, will invoke for its main argument the legal doctrine of “preemption,” which is based on the Constitution’s supremacy clause and says that federal law trumps state statutes. Justice Department officials believe that enforcing immigration laws is a federal responsibility, the sources said…The preemption doctrine has been established in Supreme Court decisions, and some legal experts have said such a federal argument likely would persuade a judge to declare the law unconstitutional.

But lawyers who helped draft the Arizona legislation have expressed doubt that a preemption argument would prevail.

Local constitutional law professor at the UMKC School of Law, practicing attorney, and candidate for Kansas Secretary of State, Kris Kobach is co-author of Arizona's SB 1070. Kobach calls the lawsuit "political" and stated that it was specifically crafted to withstand such a challenge. Kobach published an article on National Review Online in June giving his perspective on the merits of the government's potential case after Hillary Clinton let it leak in Ecuador that Obama intended to sue Arizona. Kobach will appear today on Fox's Cavuto and can be expected to be making the rounds of both talk TV and radio as this case heats up.

In a move to quell growing public anger and mounting fear over illegal immigration along the Southwest border, President Barack Obama is ordering up to 1,200 additional National Guard troops to the border area and requesting an additional $500 million from Congress to slow the flow of migrants.

In addition to the troops, the funding will be used to increase Justice Department and Department of Homeland Security activities at the border with Mexico “to include increased agents, investigators, and prosecutors, as part of a multi-layered effort to target illicit networks trafficking in people, drugs, illegal weapons, and money,” an administration official said Tuesday.

The announcement seemed designed to blunt an amendment in the Senate by Sen. John McCain (R-Ariz.) to provide $250 million for deployment of 6,000 National Guard troops to the border. And the White House move was quickly denounced by Republicans, who criticized it as insufficient, and by immigration reform advocates, who accused the White House of engaging in “political theater.”

“It’s simply not enough. We need 6,000,” complained McCain, who is opposed by immigration foe J.D. Hayworth in a GOP primary.

“The guard troops have had a very salutary effect. That’s why we need 6,000 of them,” McCain said in a speech on the Senate floor. He said such troops were needed to head off violent incidents such as one in March where an Arizona rancher was allegedly killed by someone crossing the border illegally.

Just before word of the border aid package emerged Tuesday afternoon, McCain squared off with the president over the issue during the closed-door session at the Capitol. “We need to secure the borders first,” McCain said afterward. “He didn’t agree."

Immigrants’ rights advocates, who have been grumbling for months about lackluster support from the White House for immigration reform legislation, said Obama’s move amounted to pandering that wouldn’t do much to solve the border area’s problems.

“Deploying additional National Guard without a clear strategy to end arms or drug smuggling is a response to tired talking points,” said Ali Noorani of the National Immigration Forum. “Without true immigration reform, the political theater will continue and billions will continue to be wasted on misguided border security measures.”

Fox News is reporting that Arizona has announced that in view of the Los Angeles City Council’s intention to boycott Arizona because of SB1070, a state official will bring into question badly needed electricity that the city of L.A. currently purchases from Arizona.

Uh-oh.

Hey, Mayor Villaraigosa, Ed Reyes, Janice Hahn and the rest of the city council, I guess it’s time for you to put up or shut up. Arizona has just called your bluff.

Gary Pierce, a commissioner of the five-member Arizona Corporation Commission wrote a letter to Mayor Villaraigosa clearly stating that Arizona would be more than happy to divest Los Angeles’ interest if that is what Villaraigosa’s city wants to do.

L.A. passed a resolution on May 13th to limit travel to Arizona and to boycott Arizona businesses. By the way, it doesn’t say boycott “some business”, it just says “boycott business.”

Upset and misinformed because of ignorance of the language of SB1070, the Los Angeles City council voted to “send a message” to Arizona that the city of Los Angeles frowns on Arizona implementing a law that will arguably promote discrimination against brown skin people.

One of the sponsors of the bill, Ed Reyes complained that he could be thrown in jail like a common criminal and deported back to Mexico, even though Ed was born and raised in Los Angeles.

Just more of the misinformation I guess.

The L.A. City Council voted 13-1 in favor of this resolution. So, Arizona indignant that anyone outside of their state could judge whether they needed a bill like 1070 to correct decades of an open borders problem decided to up the ante on L.A. and respond.

Gary Pierce spoke only for himself, but for sure he has the heart of many Arizonans both in government and regular citizens that as long as Los Angeles felt that way they should call their bluff and see just how committed that commitment was.

Pierce pointed out that you can’t boycott a candy store and only buy certain candies. That’s no way to make a point or as L.A. likes to put it, “send a message.”

In the letter Pierce wrote to the Mayor of L. A. "I received your message; please receive mine. As a statewide elected member of the Arizona Corporation Commission overseeing Arizona's electric and water utilities, I too am keenly aware of the 'resources and ties' we share with the city of Los Angeles.”

It could be that Ed Reyes and the rest of that motley crew downtown is really sweatin’ this one out.

"I am confident that Arizona's utilities would be happy to take those electrons off your hands," Pierce continued. "If, however, you find that the City Council lacks the strength of its convictions to turn off the lights in Los Angeles and boycott Arizona power, please reconsider the wisdom of attempting to harm Arizona's economy."

Pierce gave them a way out, but a way out of what? It appears that no matter what L.A. does it will not look good. If they take Arizona up on its offer, the city of Los Angeles goes dark and there will be some pretty angry Angelinos out there. Or, they can back away from their threat of a boycott and become the sniveling, slimy, cowardly bunch that a lot of us accuse them of being.

Not much of a choice, is it?

Currently, Los Angeles gets about 25% of its electrical power from Arizona. That is a significant amount. Los Angeles could not do with that much less electricity. Hell, we need more than that now. So, I think Arizona has Ed and his boys by the old maracas and they are beginning to squeeze hard.

If Los Angeles wants to boycott Arizona, it had better get used to reading by candlelight.

That's the message from a member of Arizona's top government utilities agency, who threw down the gauntlet Tuesday in a letter to Los Angeles Mayor Antonio Villaraigosa by threatening to cut off the city's power supply as retribution.

Gary Pierce, a commissioner on the five-member Arizona Corporation Commission, wrote the letter in response to the Los Angeles City Council's decision last week to boycott the Grand Canyon State -- in protest of its immigration law -- by suspending official travel there and ending future contracts with state businesses.

Noting that a quarter of Los Angeles' electricity comes from Arizona power plants, Pierce threatened to pull the plug if the City Council does not reconsider.

"Doggone it -- if you're going to boycott this candy store ... then don't come in for any of it," Pierce told FoxNews.com.

In the letter, he ridiculed Villaraigosa for saying that the point of the boycott was to "send a message" by severing the "resources and ties" they share.

"I received your message; please receive mine. As a statewide elected member of the Arizona Corporation Commission overseeing Arizona's electric and water utilities, I too am keenly aware of the 'resources and ties' we share with the city of Los Angeles," Pierce wrote.

"If an economic boycott is truly what you desire, I will be happy to encourage Arizona utilities to renegotiate your power agreements so Los Angeles no longer receives any power from Arizona-based generation."

Appearing to tap into local frustration in Arizona over the raft of boycotts and threatened boycotts from cities across the country, including Los Angeles, Pierce warned that Arizona companies are willing and ready to fight boycott with boycott.

"I am confident that Arizona's utilities would be happy to take those electrons off your hands," Pierce wrote. "If, however, you find that the City Council lacks the strength of its convictions to turn off the lights in Los Angeles and boycott Arizona power, please reconsider the wisdom of attempting to harm Arizona's economy."

Pierce told FoxNews.com.that he was speaking for himself, not the entire commission, though he has the support of at least one other member. But Arizona has some serious leverage over Los Angeles, as well as the rest of California. The state and city get electricity from a nuclear power plant outside Phoenix, as well as from coal-fired power plants in northern Arizona and two giant hydroelectric power generators along the Colorado River.

Despite that, the Los Angeles City Council voted overwhelmingly last week to ban future business with Arizona -- a decision that could cost Arizona millions of dollars in lost contracts.

Los Angeles officials were furious with the Arizona immigration law passed last month and joined local officials in cities across the country in pushing boycotts to register their dismay. Critics say the law will lead to racial profiling and civil rights abuses.

Arizona officials have defended the law, saying the state needed to take its illegal immigration problem into its own hands. Pierce said he's "supportive" of the state's efforts to control the border.

The law requires local law enforcement to try to verify the immigration status of anyone they have contact with whom they suspect of being an illegal immigrant. It empowers them to turn over verified illegal immigrants to federal custody. The legislation explicitly prohibits screening people based solely on race or national origin

City requires lingerie store to get food permit for edible undies

Rosemary Benitez thought it was a joke at first. She was told her store was going to need a food permit in order to stay in business.

But Benitez doesn't own a restaurant. She owns the Shades of Love lingerie store on West Bitters road.

Shades of Love sells racy lingerie, high heel shoes, adult toys and items meant to enhance a couple's sex life. However, some of those items are edible. That's why the health department ruled the store needed a food permit.

The permit costs about $230 a year. It also means the store is subject to regular health inspections.

Beneitez says, "Everything is sold as novelty. Everything in the box says 'novelty item' only... It's not something you sit down and actually eat. It's more for licking and tasting. Edible? No. It's not going to fill you up."

San Antonio's Sanitarian Services Manager, Stephen Barschewski, told us, "Any facility in the city of San Antonio that sells edible substance requires a food establishment permit. One, it's the law. Two, in case there's a recall, we certainly want to know the source."

Beneitez countered back, "I don't think you would actually eat, lick, or taste enough of this that it would cause a big problem (as in food recalls). It's absurd to me."

KENS 5 has learned of other stores, like Dillard's department stores and several auto parts stores, that are also required to have food permits. The reason is because they sell chocolate bars.

Obama's newly released medical report reveals he's taking a prescription medication for jet lag.

Tucked away under a list of medications in the report on President Obama’s recent physical exam is this intriguing notation: “Jet lag/time zone management, direct physician prescribed program, occasional medication use.” Obama’s doctor, Navy Capt. Jeffrey Kuhlman, didn’t say what drug the president might be taking to fight the mind-numbing effects of crossing too many time zones. But sleep doctors we consulted say one possibility is Provigil, a stimulant that is regularly prescribed to help people fend off excessive sleepiness.

Fans claim you get all the benefits of a triple shot of espresso without the jitters or anxiety that can accompany a massive hit of caffeine.

While the White House won't say what the president is actually taking, Provigil (also known by its generic name modafinil) is an intriguing possibility. The drug has acquired an almost mythic status in recent years as a pill that makes it possible for the user to bypass the all-too-human need for sleep and work 24 or even 36 hours at a stretch. Manufactured by Cephalon, it’s in a class of medications called “wakefulness promoting agents.” Fans claim you get all the benefits of a triple shot of espresso without the jitters or anxiety that can accompany a massive hit of caffeine. It’s reported to be increasingly popular among sleep-deprived cohorts like long-distance truckers, fighter pilots, and students pulling all-nighters–and brought in $1 billion for Cephalon in 2008.

One little hitch: It’s not approved by the Food and drug Administration for this purpose. The FDA says modafinil can only be marketed as a treatment for three things: narcolepsy, shift-work sleep disorder and excessive daytime sleepiness in patients who have been treated for obstructive sleep apnea. Using the drug to keep patients awake after a long trip would be considered “off-label,” although it’s perfectly legal and very common, says Shives. And that off-label status could soon change. The FDA is reviewing Cephalon’s application to market a drug called Nuvigil, which is similar to Provigil, as a jet-lag remedy.

Modafinil does sometimes have side effects, including rashes, headaches, dizziness, and nausea. Still, occasional use of the drug (if that’s indeed what Obama has taken) isn’t likely to have long-term consequences, doctors say. “I wouldn’t be worried,” Shives says. Shives said she thinks Obama could also be taking a sleep aid like Ambien or Lunesta “so that he can go to sleep at a time when it might be unnatural for his circadian rhythm.” The effect of both drugs can last up to eight hours, which is why you shouldn’t take them if you need to be alert in less time. CRP, The research organization, which tracks political donations, recently analyzed the assets and liabilities of lawmakers based on 2008’s required annual financial disclosures. The center estimated each politician’s net worth by adding together the lawmaker’s range of assets and then subtracted the range of liabilities.

The midpoint of that resulting range was used to rank the politicians.

In the Senate, 68 legislators were estimated to be worth at least $1 million, led by Herb Kohl, a Democrat from Wisconsin, who was worth an estimated $214,570,011 in 2008. The average net worth across the Senate was $13,989,022.98.

As Washington reels from the news of 10.2 percent unemployment, the Center for Responsive Politics is out with a new report describing the wealth of members of Congress.

Among the highlights: Two-hundred-and-thirty-seven members of Congress are millionaires. That’s 44 percent of the body ‒ compared to about 1 percent of Americans overall.

CRP says California Republican Rep. Darrell Issa is the richest lawmaker on Capitol Hill, with a net worth estimated at about $251 million. Next in line: Rep. Jane Harman (D-Calif.), worth about $244.7 million; Sen. Herb Kohl (D-Wis.), worth about $214.5 million; Sen. Mark Warner (D-Va.), worth about $209.7 million; and Sen. John Kerry (D-Mass.), worth about $208.8 million.

All told, at least seven lawmakers have net worths greater than $100 million, according to the Center’s 2008 figures.

“Many Americans probably have a sense that members of Congress aren’t hurting, even if their government salary alone is in the six figures, much more than most Americans make,” said CRP “What we see through these figures is that many of them have riches well beyond that salary, supplemented with securities, stock holdings, property and other investments.”

The CRP numbers are somewhat rough estimates ‒ lawmakers are required to report their financial information in broad ranges of figures, so it’s impossible to pin down their dollars with precision. The CRP uses the mid-point in the ranges to build its estimates.

Senators’ estimated median reportable worth sunk to about $1.79 million from $2.27 million in 2007. The House’s median income was significantly lower and also sank, bottoming out at $622,254 from $724,258 in 2007.

But CRP’s analysis suggests that some lawmakers did well for themselves between 2007 and 2008, even as many Americans lost jobs and saw their savings and their home values plummet.

Senate Minority Leader Mitch McConnell (R-Ky.) gained about $9.2 million. Sen. James Inhofe (R-Okla.) gained about $3 million, Sen. Daniel Inouye (D-Hawaii) had an estimated $2.6 million gain, and Richard Shelby (R-Ala.) gained about $2.8 million.

Some lawmakers have profited from investments in companies that have received federal bailouts; dozens of lawmakers are invested in Wells Fargo, Citigroup, Goldman Sachs and Bank of America.

Among executive branch officials, CRP says the richest is Securities and Exchange Commission Chairwoman Mary L. Schapiro, with a net worth estimated at $26 million.

One caveat on those numbers: Federal financial disclosure laws don’t require members to list the value of their personal residences. That information could alter the net worth picture for many lawmakers.
