Joe Biden stored top-secret files with the “sensitive compartmented information” (SCIF) designation at Penn Biden Center in DC.
The documents were dated between 2013 and 2016, according to the source.
The documents were discovered by Biden’s lawyers on November 2 – just days before the 2022 midterm elections.
Top secret intelligence documents related to Ukraine, UK and Iran were found in Joe Biden’s private office, according to CNN.
The roughly 10 documents are from President Biden’s vice-presidential office at the center, the sources said. CBS News has learned the FBI is also involved in the U.S. attorney’s inquiry
Attorney General Merrick Garland assigned US Attorney for the Northern District of Illinois John Lausch (a Trump appointee) to review the documents.
Top White House advisors also knew Joe Biden hid classified documents at his private office.

While there is currently no text available for the impeachment articles filed against Mayorkas, Fox News reported last week that Fallon's first article alleges that Mayorkas has failed to faithfully execute the "Secure the Fence Act of 2006." The article says that law requires the secretary of Homeland Security to "maintain operational control over the entire international land and maritime borders of the United States."
The second article alleges that Mayorkas, "in violation of his constitutional oath, willfully provided perjurious, false, and misleading testimony to Congress." To back up that charge, the article quotes Mayorkas' testimony during April 26 and Nov. 15 congressional hearings in which he said the border was secure.
The final of the three articles charges that Mayorkas "publicly and falsely slandered" border agents who were accused – but later cleared – of whipping Haitian migrants in Del Rio, Texas, in 2021.
Texas Republican Rep. Pat Fallon has filed impeachment articles against Homeland Security Secretary Alejandro Mayorkas, delivering on a promise he made last week before the 118th Congress was officially sworn in.
The articles of impeachment against Mayorkas for "high crimes and misdemeanors," known as House Resolution 8, were introduced by Fallon in the House on Monday and have been referred to the House Judiciary Committee.
Last week, Fallon vowed to file impeachment articles against Mayorkas after the Congress was sworn in. The effort from Republicans in the House is one of many that the new GOP majority will take as it works to fight the Biden administration on issues related to immigration and the southern border crisis.
"Since day one, Secretary Mayorkas’ policies have undermined law enforcement activities at our southern border," Fallon said in a statement to Fox News last week. "From perjuring himself before Congress about maintaining operational control of the border to the infamous ‘whip-gate’ slander against our border patrol agents, Secretary Mayorkas has proven time and time again that he is unfit to lead the Department of Homeland Security."

"The 511-page report by the U.S. Customs and Border Protection's Office of Personal Responsibility found ‘no evidence that [Border Patrol agents] involved in this incident struck, intentionally or otherwise, any migrant with their reins,’" Fallon writes. "Secretary Mayorkas slandered his own Border Patrol agents and TXDPS Troopers involved in this incident, contributing to a further decrease in already-low morale among agents."
During a visit to El Paso in late November, Rep. Kevin McCarthy, R-Calif., who was elected by his GOP colleagues to serve as House speaker on Friday, called for Mayorkas to resign over his handling of the migrant crisis at the southern border and warned of an impeachment inquiry when Republicans officially took control of the House.
"If Secretary Mayorkas does not resign, House Republicans will investigate every order, every action and every failure and will determine whether we can begin impeachment inquiry," McCarthy said at the time.
Mayorkas on Sunday said he will not resign over his handling of the border crisis and insisted he will be ready for future investigations by House Republicans while continuing to fulfill his daily responsibilities.
During an appearance on ABC's "This Week," Mayorkas previewed President Biden's visit to El Paso, Texas, and was pressed by anchor George Stephanopoulos to respond to McCarthy's call for him to resign and whether he has any intentions of doing so.
"I do not. I've got a lot of work to do, and we're going to do it," Mayorkas said.
In response to previous calls to impeach Mayorkas, a DHS spokesperson said in November that they amount to little more than finger-pointing from Congress.
"Secretary Mayorkas is proud to advance the noble mission of this Department, support its extraordinary workforce, and serve the American people," the spokesperson said in a statement. "Members of Congress can do better than point the finger at someone else; they should come to the table and work on solutions for our broken system and outdated laws, which have not been overhauled in over 40 years."

Fox News confirmed a batch of classified documents were discovered from Biden's time as Vice President
Twitter users pounced on the news revealing that President Biden’s personal attorneys discovered a "small number of documents with classified markings" in a locked closet at the Penn Biden Center on Nov. 2.
According to the attorneys, the documents were found after they planned to vacate the office space, and the National Archives soon took possession of them on Nov. 3. Special counsel to the White House Richard Saubel has since said that the president is cooperating with the Department of Justice over reviewing the matter.
Many people pointed out the similarities between this news and the FBI raid on former President Trump’s Mar-a-Lago home last year when FBI seized approximately 300 classified documents. At the time, Biden called out Trump as "totally irresponsible" and questioned how this could happen in the U.S.
"How that could possibly happen? How anyone could be that irresponsible? And I thought what data was in there that would maybe compromise sources and methods?" Biden told 60 Minutes. "And it just — totally irresponsible."
Conservative Twitter users quickly mocked the irony of the news as well as the contrast between the treatment of Biden and Trump.
"But... but... I was repeatedly assured that keeping classified documents in your private residence was an impeachable offense if not treason. Watch how fast this disappears," Hot Air writer Jazz Shaw tweeted.
"HOLY CRAP, @FBI, DID YOU GUYS SEE THIS?!?!? WHEN'S THE RAID AT BIDEN'S HOUSE?!?" Radio host Dan O’Donnell posted.
X Strategies senior digital strategist Greg Price similarly wrote, "SEND THE FBI. RAID IT IMMEDIATELY. JOE BIDEN STOLE SECRETS FROM OUR GOVERNMENT."
Washington Examiner writer Jerry Dunleavy tweeted, "objectively funny that Biden had some classified docs stashed away and everyone knows it."
"I'm not really impressed unless your classified is on a bootleg homebrew email server in a basement. Everything else is anticlimactic," American Commitment president Phil Kerpen wrote.
By contrast, liberal Twitter users attacked the mainstream media’s reporting on the news, insisting that Trump’s example was far worse.
Writer Thor Benson tweeted, "Biden's people discovering a small number of classified documents and then immediately turning them in is not the same as Trump intentionally taking a large number of highly classified documents and then lying about it, but I'm guessing we're in for some dumb both sides nonsense."
"This tweet has big October 2016 energy," Rolling Stone digital director Lisa Tozzi wrote.
Podcast host Bob Cesca wrote, "The documents were immediately handed over to NARA and DOJ was informed. But good job suggesting a parallel to Trump's document theft. ‘Discovered and returned’ could've fit your tweet. Delete your account, CBS News. Pathetic."

Comer says committee plans to investigate classified records found at Penn Biden Center
Rep. James Comer, R-Ky., chairman of the House Oversight Committee, told reporters Monday night that the handling of the discovery of classified documents by President Joe Biden's lawyers that were taken from the White House six years ago is a display of a "two-tier" system of justice.
On Monday, Fox News confirmed that a batch of records from Biden's time as vice president, including a "small number of documents with classified markings," were discovered at the Penn Biden Center by the president's personal attorneys on Nov. 2, according to Richard Saubel, special counsel to the White House.
The attorneys found the documents in a locked closet while preparing to vacate office space at the center, which the president used from mid-2017 until he began the 2020 campaign.
Comer told reporters that the handling of these documents is a stark contrast to the FBI's raid of former President Donald Trump's Mar-a-Lago home in Florida last year in search of classified documents taken after Trump lost his re-election bid in 2020.
House Oversight Committee Chairman James Comer, R-Ky., says the committee will investigate the Biden classified documents.

"Is the White House going to be raided tonight?" Comer asked. "Are they going to raid the Biden center? I don’t know."
"This is further concern that there's a two-tier justice system within the DOJ with how they treat Republicans vs. Democrats … certainly how they treat the former president vs. the current president," Comer added.
Comer said that after the Mar-a-Lago raid, according to the research his office conducted, they found that "every president had accidentally packed documents that may or may not be considered classified."
"But they weren't raided," he added.
Comer said the Oversight Committee plans to send a letter to the National Archives, and depending on where the investigation leads, would be open to holding a hearing on the matter.
"President Biden has stated that taking classified documents from the White House is ‘irresponsible,'" Comer said in a statement. "Under the Biden Administration, the Department of Justice and National Archives have made compliance with the Presidential Records Act a top priority."
"We expect the same treatment for President Biden, who has apparently inappropriately maintained classified documents in an insecure setting for several years," Comer added.

According to the Post Millennial, this “weaponization of government” committee will chiefly focus on four areas: the collusion between the Regime and Big Tech, the politicization of the FBI, the Department of Injustice’s targeting of parents at school board meetings, and Anthony Fauci. These are the things conservatives have been demanding from Republicans for the past two years.
“The 118th House of Representatives will see the formation of a new select committee, headed by Jim Jordan, to dig into the abuse of power and the Weaponization of Government. This investigative panel will demand emails and correspondence between the Biden administration and big tech companies, and follows the massive revelations that came to light through the recent release of the Twitter Files.”
“The probe into communications between tech giants and President Biden’s aides will look for government pressure that could have resulted in censorship or harassment of conservatives — or squelching of debate on polarizing policies, including the CDC on COVID,” Axios reports.
“If government personnel and agencies do not comply, subpoenas are likely to be issued, per a GOP source. The GOP is committed to digging into “the politicization of the FBI,” which not only includes the work done to discredit accurate reporting from the New York Post in the lead-up to the 2020 presidential election, but the allegations of Russian election interference in the lead-up to the 2016 election.”
“The use of Biden’s Department of Justice to go after parents who spoke out angrily at school board meetings will be investigated as well. Ohio’s Jordan was instrumental in the discovery that the letter requesting a DOJ investigation into these parents, issued by the National School Boards Association, was actually requested to be written by Merrick Garland’s DOJ in the first place. The head of the NSBA was then given a plum post in the administration.”
