The Keystone Cop


Director Comey. in his ham handed approach to the seizure and search of Anthony Weiner's laptop, appears to have violated the Rule of Law, a DOJ directive, FBI protocol, precedent and the US Constitution in one fell swoop.

To begin, Comey violated a directive from the Department of Justice to not publicly report the alleged Huma Abedin emails existing on Anthony Weiner's laptop. He took it upon himself to send a letter to republican members of congress after receiving the directive to not broach this so near the election. This in clear violation of both precedent and FBI procedures.

That however is not the sum total of his misdeeds in this case.

The FBI apparently illegally seized the laptop. The reason it was illegally obtained is because, according to reports from FBI sources, no search warrant existed to allow the seizure and the search of the laptop.

No search warrant exists for the FBI to search any of the supposed Huma Abedin emails that may be found on the laptop. A search warrant would have clearly limited the search parameters and the purpose for the search. Since the investigation involved Anthony Weiner's sexting, there would have been no allowance made to broaden the search beyond that investigation.

The proper procedure should have been for the FBI to appear before a federal judge stating that there existed "probable cause" to seize and search Anthony Wiener's laptop for evidence that he had sexted with an girl who lived in another state. That search warrant, if granted, would have limited the scope of the search. (the laptop and evidence of Anthony Wiener's sexting). Any subsequent information gleaned from a search would have been illegally obtained and not permitted under the terms of the search warrant.

According to reports there was no search warrant obtained for Anthony Weiner's laptop. There certainly was no search warrant obtained to search his laptop for Huma Abedin's emails. In fact the FBI is legally restrained from even examining the supposed Huma Abedin emails found on Weiner's laptop.

Comey seemingly engaged in partisan election tampering. He stands at a point of jeopardy regards apparent Felony Election Tampering. He additionally stands at a point of legal jeopardy regards his apparent violation of the US Constitution (specifically the fourth amendment provisions against illegal search and seizure).

Comey's portrayal of the consummate Keystone Cop is affecting this election and casts doubt on the outcome. That, beyond his flagrant disregard of law, is the more damaging aspect of this matter.

It bears noting that Comey is a lifelong republican and he apparently wanted to place his thumb on the scale.

Seems like a very odd thing for someone in a non-political office to do.

He could easily have held off until after the election.

Smacks of inappropriate political interference.

What I'd like to know is whether the FBI had a search warrant to enter Weiner's home and seize his computer? When the FBI is investigating someone, normally it's done without the person even knowing there's a investigation going on.

Last April 5 Abedin was interviewed by the FBI and told them about the multiple e-mail accounts she used for State Dept. business. The FBI was told she forwarded tons of work e-mails to her ya-Hoo account so she could print them at home. She told them she was “unaware of the classification of the document and stated that she did not make judgments on the classification of material she received. Instead, she relied on the sender to make that assessment and to properly make and transmit the document.”

Don, to me everyone seems to be negligent and at fault with these e-mails. Hillary, Huma, the Justice Dept. for allowing Comey to make the final decision about Hillary's investigation, Comey for a sloppy investigation and also for spilling the beans when he knew absolutely nothing to spill the beans about. Poor Hillary. I can't even imagine how she must feel right now, but still none of this would have happened if she had used the proper server in the first place.
