Kansas Suprme court to decide? Democrat Governor against Republican Leglistalture.


Well not the entire legislature just a 7 member panel committee of 5 Republicans and 2 Democrats.

The case boils down this.. Can the governor, in a State of Emergency . Outlaw gathering of 10 or more people for church services Easter Sunday?

I was interested in the arguments.. The hearing was on the internet, so I listenedto the whole thing

I expected a conflict between constitutional freedom of religion and Assembly and the Emergency declaration.

Not a single word about that...

Not a single word about the powers of the Legislature and the Governor..
What the conflict did come .. Was the power of the governor versus the power of a seven member panel of legislators, led by Republicans, to overturn any executive orders.

It is clear in the Kansas Constitution that with a full vote of the legislature. that a governor's order can be overturned. When the Kansas Legislature is not in session.. Powers of oversight go the Legislative Committee.

The questions were these..
Does the power of oversight of the committee translate to a proxy from the entire legislature.. To make laws. And Does that TRUMP executive powers

The State Legislature Is suppose to be in session, but has been suspended because of the virus.

That statutes governing the committee do no name the specific power..to do what it's doing.. but like President Trump and Trump's executive powers the Republican Committee of legislators is assuming that which is not specifically excluded or assigned specifically to the Legislature . is within their Powers.

If the Kansas supreme court ruled in favor of the Legislator committee. It would virtually strip then powers of the Governor about the pandemic.
There was an avoidance of religious freedom and Freedom to assemble. WHY..?

Because it was never about that..that specific ruling would have allowed services on Easter, and the ability to assemble. It's end result would have voided the governor actions to prevent, social distancing and gatherings.... the Republican did not want that.

What the legislature wants... is to be able to overrule the governor if and When Trump opens the economy. The governor could be forced by the the committee of Republican legislature to comply.. Pure and simple it was a typical Republican power grab.

The irony and hypocrisy of Trump Republicans is fricken amazing..

Just IMAGINE.....The governor of Kansas as the President of the United. And the Seven member Committee.. Run by Nancy Pelosi.. asking for the same thing.

Wow what a fascinating situation. I think the same sort of thinking is running amok in Wisconsin as well. It reminds me of the over 700 signing statements made by GW Bush. I know its a bit of a stretch to say this... but America is quickly, very quickly losing its embrace of democracy. I may witness its end before I leave this earth.

I was 99% sure.. The Kansas supreme court would rule in favor of the governor..Which it did.

Much of the argument..made by the governor's office...was NOT about the specific text, of the suit..The argument they made was the Constitutionality of a seven member legislative panel..and it's power to veto any Governor action.

the Kansas Supreme court. did not want to go there..It's seems they ruled on the specific text.. Even though neither argument dealt with the specific text, just the constitutionality
Basically the Kansas said if the entire legislature voted on a different wording of the resolution..it would then have to decide. It appeared from the beginning moment of this hearing.. that was going to be the final decision.
no way was the Supreme either going to give the seven member that power.. nor were they going to give the Governor Carte Blanche, and void the seven member panel.

The lawsuit was absurd...As MORE than 90% of the churches in Kansas has voluntarily complied.

The coronavirus has now put everything on an even keel..
the Trump republicans and their methodology is being putting to the test..

The use of words which form either a predilection, bias,or partiality, to persuade a public opinion.....so as to allow the abuse one's power. With the idea that the words themselves have no basis of good and evil.. but to invoke good and evil in the words themselves..

Predilection: implies a preconceived liking, formed as a result of one's background, temperament, etc.,
Partiality: implies an inclination to favor a person or thing because of strong fondness or attachment
Bias: implies a mental leaning in favor of or against someone or something that interferes with impartial judgment few of us are without bias of any kind

Trump does it with IMMIGRATION, JOBS, NATIONAL SECURITY, THE ECONOMY, LIBERALS, FREEDOM OF RELIGION, NEWS MEDIA, CONGRESS, LIBERALS, DEREGULATION AND
ANTIDISESTABLISHMENTARIANISM..

Some Liberals aren't immune..GUNS, EVANGELICALS, WALL STREET, RACISM, CORPORATIONS, ELITISM, FASCISM, GREED, COMPASSION, EMPATHY, REGULATIONS, AND TRUMP SUPPORTERS,

You fight the division with commonality....The Coronasvirus has leveled the playing field...an attack on one is an attack on all. Short of another kind of war.. There was no other way to expose the truth of it.
